Short Term Rental Agreement
Bay Trees, Hillside Villas, The Grove Residencies


This SHORT TERM RENTAL AGREEMENT (the “Agreement”) is entered into by and between the renter, hereinafter referred to as the “Guest(s)“, and the owner hereinafter referred to as the “Owner”, together known as the “parties”, and is regarding the holiday letting of the property known as Bay Trees Hillside Villa at The Grove Residencies, Holetown, St James, Barbados (the “vacation property”);

AND constitutes a contract between the Guest(s) and the Owner.  Please read this Agreement thoroughly.  Paying the required rental fee(s) is confirmation that the Guest(s) agree to the following terms and conditions.   Any monies received by the Owner or Agent(s) for occupancy of vacation property indicate the acceptance of the terms and conditions of this Agreement and it is the responsibility of the Guest(s) to be familiar with all policies within this Agreement. 

DEFINITIONS:

“Agent“ or “Agent(s)” will mean any online Internet company and/or any rental agent acting on Owner’s behalf.

THE PARTIES HEREBY AGREE as follows:

  1. Reservation requirements - are not considered "guaranteed" until part payment (the “deposit”) or 100% of the total rental fee, plus 100% of damage waivers, cleaning fees, or any additional items, are received by the Owner at the time of booking.  Reservations consisting of three or less rental nights or reservations booked 14 days or less prior to arrival date will require payment in full on reservation date.  Reservations consisting of three or more rental nights require 50% payment of rental fees plus 100% of damage waivers, or any additional items on reservation made date OR refer online agent’s terms.  The remainder is due no less than 14 days prior to arrival date to secure the vacation property OR refer to online agent’s terms.  If payment in full is not received by the Owner 30 days or more prior to Guest arrival, reservation may be subject to cancellation without refund, no exceptions (if booking via Internet, refer to the online terms).
  2. Reservation fee - all reservations that need date and/or property changes are subject to a non-refundable fee - see Agent’s terms via online system.  
  3. Confirmation of reservation(s) - will be notified via our online Agent(s) or by email confirmation to Guest(s) upon receipt of the reservation advance payment.  Guest(s) may also print confirmation from online Agent's website after payment.  Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations.  Any errors must be directed to the Owner immediately.  
  4. Accepted forms of payment - is via Agent(s) (acting on Owner’s behalf) or bank transfer only. 
  5. Damage deposit - a security/damage Deposit is required before check-in.  Deposits may be paid via our Agent(s) or by bank transfer.  This Deposit will be returned within the terms of our Agent(s) (see their terms online) or 30 days of the departure date, provided proper check-out procedures are followed, and there is no breakage or damage to the premises. 
  6. Cancellations - are subject to Agent(s)/Owner’s cancellation policy, no exceptions.  
  7. Refund policy - Agent(s) and/or Owner cannot guarantee against mechanical failure of air conditioning, TVs, Telephone, WiFi, Satellite Receivers, or other appliances.  Please report any inoperative equipment to Owner, and/or Agent, and/or Property Manager immediately.  They will make every reasonable effort to have repairs done quickly and efficiently.  No refunds or rent reductions will be made due to failure of appliances or equipment.  No refunds for early departures (less days than reserved).  No refunds will be given for delayed arrival.  No refunds for reducing the number of nights reserved, no exceptions.
  8. Credit Card Agreement - where applicable, you provide your credit card number as a guarantee of payment to Agent as follows: “I agree to pay all rent and charges related to property rental.  I accept all terms of the lease agreement and accept all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear during the term of my lease with Agent.  I understand that these costs will be charged to my credit card.  In the absence of another payment arrangement, I authorise Agent to charge my credit card for payment of these items.  Agent may use any funds received from me upon Agent's receipt of such funds”.  
  9. Maximum occupancy - at all times, the maximum occupancy is the number the home sleeps (this is 2 per double bed and 1 per single bed) [including infants].  Sleeping limits shows as (for instance) “sleeps 6".  Guests and visitors must be pre-approved by Agent in advance.  [(Each child counts as one guest)].  If you bring in extra guests or visitors without prior approval and payment, guest(s) will be asked to vacate the property.  Any security payments and all rent will be subject to forfeiture.  Absolutely No House Parties including small dinner parties or get togethers of any kind allowed.  
  10. Age requirements - Guest(s) under the age of 21 unaccompanied by a parent or legal guardian will not be permitted to register and will lose all funds paid to Owner/Agent.  Any reservations made under false pretences will result in loss of advance payments and possible removal of guest from rental unit.  No Fraternities, no Sororities, no house parties, no exceptions!  Violations of this will result in immediate eviction with no refund of any monies.  The Owner/Agent reserves the right to refuse service to anyone. 
  11. Air conditioning and ceiling fans - units are not be run for long periods of time and are not to be left running when the vacation property is left unoccupied.  Windows and doors should be closed to allow air conditioning units to run efficiently.
  12. Furnishings - are subject to change without notice.  Furniture, bedding, mattress pads, utensils or any other property supplied with the vacation property must not be taken out.  Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest(s).  
  13. Furniture, fixtures and fittings - items of furniture are placed strategically throughout the vacation property and must not be moved.  Moving furniture may cause damage and may affect the Guest’s damage deposit.  Guests to be mindful to not place personal items on fragile surfaces. 
  14. Items Guest(s) must provide - any personal articles, any food and drink items, coffee filters, clothes washing powder/liquid, paper towels, napkins, foil, favourite pillow, videos.  Extra towels for pool usage are suggested. 
  15. Linens - A basic supply of linen is provided in the property.  Bed linen and bath towels are changed during your stay.  The startup set of bath soap, toilet tissue, paper towels and trash bags are not replenished for Guest(s) occupying the rental property over 2 week’s duration.  
  16. Check-In/Check-Out Times:
    1. CHECK-IN TIME is after 4:00 PM: check-in takes place at the property.  Keys are NOT available until the property is ready for occupancy.  No exceptions to this policy will be made.  Agent/Villa Manager will use reasonable efforts to have the vacation property ready for Guest(s) occupancy at check-in time, but Agent(s) cannot guarantee the exact time of occupancy.  Please contact Owner, via online system, or rental agent in advance if you may be arriving after 9:00 PM so that arrangements can be made for property keys to be picked up.  
    2. CHECK-OUT TIME is before 12 Noon: check-out is strictly enforced so that Agent/Villa Manager has adequate time to prepare the property for the next guest.  Please return keys to the Villa Manager before leaving.  Guests that do not vacate the vacation property and return the keys by 12 Noon without the consent of the Owner/Agent are subject to a fee equal to one (1) rental day.
  17. Rental assignment change - Owner reserves the right to change rental assignments without prior notice or liability in the event of a sale of the vacation property, or if the unit becomes unavailable.  Guest(s) will receive a complete refund.  
  18. Pets - NO PETS are allowed in or on the premises. Unauthorised occupancy of pets will result in immediate eviction and loss of all rents and security payments.  
  19. Listings and pricing - Information regarding individual listings is believed accurate but cannot be guaranteed.  Owner has made every effort to ensure that all the information on Agent's website(s) is current and accurate.  Rates, furnishings, fees are subject to change without notice.  
  20. Indemnification and Hold Harmless - Guest(s) agree not to indemnify and hold harmless the Owner and Agent for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the vacation property, including but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s).  
  21. Acts of God - neither Owner nor Agent(s) shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, hurricanes, war, or inclement weather.  NO REBATE OR REFUND will be offered in these circumstances.  
  22. Violation of Agreement - if Guest(s) violates any of the conditions of this Agreement, Owner/Agent may terminate this Agreement and enter premises.  Upon notice of termination of this Agreement, Guest(s) shall vacate the property immediately and forfeit all rents and security deposits.  
  23. Lost and Found – Agent nor Owner will be responsible for Guest(s) personal property left behind or lost during stay.  If they are able to find an item left behind they are willing to ship it to the registered Guest upon request.  Shipping charges will be charged to the Guest once given a valid credit card number.  Items unclaimed will be held for a maximum of 14 days at which time the Villa Manager/Agent reserves the right to dispose of or may elect to donate the item(s) to a local charity.  

WE AGREE THAT PAYMENT OF DEPOSIT AND FULL RENTAL FEE IS CONFIRMATION THAT WE HAVE READ AND FULLY AGREE TO ALL OF THE ABOVE POLICIES.
